These Subscription Terms of Service ("Terms") govern the use of the monthly subscription plan ("Subscription Plan") for the AI Learning Companion for History ("the Plugin"), provided by Warmer Sun Education ("We," "Us," or "Our"). By purchasing and using the Subscription Plan, you ("Subscriber," "You," or "Your") agree to be bound by these Terms, our Privacy Policy, and any other related document referenced herein.
The Subscription Plan entitles the Subscriber to a quota of 3,000 requests per month. The Subscription Plan is offered on a monthly basis, with recurring payments.
The Subscription Plan is intended for use by the Subscriber only. Subscribers are responsible for maintaining the confidentiality of their login credentials and are fully responsible for all activities that occur under their account. Sharing account credentials is strictly prohibited and constitutes a violation of these Terms.
To access the Subscription Plan, Subscribers must register with a valid email address and agree to payment processing through Stripe. Payment details are processed and stored by Stripe and are not accessible by Warmer Sun Education. Subscribers are responsible for keeping their contact and payment details up to date.
Subscribers are strictly prohibited from: a. Sharing account credentials with any third party. b. Using the Subscription Plan for any illegal or unauthorized purpose. c. Attempting to exceed the assigned quota of requests.
Any violation of the above may result in immediate termination of the Subscription Plan, without refund, and may subject the Subscriber to legal action.
Subscribers agree to pay the applicable subscription fee as set forth on our website. Subscription fees are non-refundable, except at our sole discretion. We reserve the right to change the subscription fees at any time, with prior notice to the Subscribers.
We reserve the right to suspend or terminate the Subscription Plan of any Subscriber who violates these Terms. Upon termination, the Subscriber will lose access to the Subscription Plan immediately, and no refund will be provided.
In no event shall Warmer Sun Education be liable for any damages, including without limitation, direct, indirect, incidental, special, consequential, or exemplary damages, arising out of, or in connection with the use of the Subscription Plan, beyond the amount paid by the Subscriber for the Subscription Plan in the month in which the event giving rise to the liability occurred.
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein, and any disputes relating to these Terms will be subject to the exclusive jurisdiction of the courts of British Columbia.
